Introduction to the project

 

This project investigates explanations for some of the significant differences that have been detected between English substantive tort law and that of some of the other states of Western Europe. It seeks to defend the propositions that (1) significant differences exist, (2) they cannot be explained wholly by reference to differing “legal cultures”, and (3) some of the differences can be explained by differences between the preferences of citizens and social practices in the different states.

 

A paper based on this research, “The Englishness of English Tort Law” was delivered at a Faculty Seminar at the School of Law, Florida State University, in August 2001, and at the Tort Subject Group, SPTL Conference, Glasgow, in September 2001.
